A new version of the I-765 has been released. Use the I-765 version dated 12/26/2019 to apply for OPT. Download the newest I-765 from the USCIS website - uscis.gov/i-765.
Why is the ISSO notifying me now?
While the I-765 is dated 12/26/2019, USCIS updated their webpage and announced the new version of the form on February 19, 2020. On the I-765 webpage, USCIS indicated that the older version of the form (dated 05/31/2018) could be used up until 04/20/2020.
At this time the ISSO is seeing some rejections, by USCIS, of Post-Completion and 24-Month Extension OPT applications that included the 05/31/2018 version of Form I-765. The ISSO wants to communicate proactively and transparently with you, and we want you to be aware of factors that may influence your practical training.
What if I have already mailed my application?
• If you printed your I-765 from the USCIS website after February 19, 2020, your application should have the correct version. If this applies to you, there is no further action for you to take..
• If you made a copy of your application before mailing it, you can check to see if you used the newest I-765 version. If you used the newest version, there is no further action for you to take.. 1point3acres.com
• If you cannot verify which version of the I-765 you submitted, you can wait for USICS to respond. If you received an I-797C Receipt Notice, it means your package has been accepted for processing. However, we do not know at this time whether submitting an old version of the I-765 form could affect the adjudication of your application.
What if my application has been receipted?
If you know that you submitted an old version of the I-765 and you received an I-797C Receipt Notice for your application package, then you have several options:
1. Wait for your application to be adjudicated. It is unclear at this time whether submitting the 05/31/2018 version of Form I-765 may affect the adjudication of your application. You may wait to receive a decision from USCIS. They will either approve your application as is, request additional evidence, or deny your application.
2. Contact USCIS Customer Service. USCIS provides a customer service phone line. You may call them to inquire whether you need to send updated information for your application. Their phone number is 1-800-375-5283. You will need your Receipt Number, found on your I-797C Receipt Notice.
3. Withdraw your OPT application and re-apply. Please note, attempts to withdraw OPT applications are not always successful. You would need to request the ISSO to cancel your request and then contact USCIS to request a withdrawal of your application. You would then need to wait until your receive an official Withdrawal Notice before submitting a new application. Please keep in mind, USCIS must receive your OPT application no later than the last day of your grace period (for Post-Completion OPT) or the end date on your EAD card (for 24-Month Extension OPT).
4. Send a completed version of the new I-765 (dated 12/26/2019) with a letter of explanation and copy of your I-797C Receipt Notice to the address on the notice.
What if I get a rejection from USCIS?
USCIS Service Centers may reject Post-Completion and 24-Month Extension OPT applications for a number of reasons, such as not signing the I-765 or not including payment for the fee..google и
• If USCIS rejects your application, they will send a "Rejection Notice" to the address listed on the I-765, letting the applicant know why the application was rejected. They will return the entire application package, including payment.
• If your original Post-Completion OPT application is rejected due to the I-765 date, you may correct your application and re-submit it to USCIS prior to the end of your grace period.
• If your original 24-Month Extension OPT application is rejected due to the I-765 date, you may correct your application and re-submit it to USCIS prior to your Post-Completion OPT end date.. From 1point 3acres bbs
