CBP Officer有权利更改入境时限，但也得有正当理由，不能没有理由和依据就把你拒
绝入境了或者随意更改入境时限。没有正当理由，就可以认为是错误，这也是为什么有
很多人都到CBP改I-94改成了。

Risks: 说的没错，问了很多cbp都说中国护照是给到护照截止之前6个月。有相关法律条例


有效期减6个月是最合规定的做法。
还曾经在买买提上看到过事后因为别的事情找CBP，CBP把本来给到护照有效期的I94 改
少了六个月的。

以前有人H4 非法滞留后在境内在USCIS更新I-94成功了。你在版上搜一下。找他的律师谈谈看怎么弄的。

以前的讨论关于EMAIL CBP改I-94，不同的CBP Office的做法不一，有不给改的，也有
置之不理没回复的，还有改成功的（LA Office）。

你可以发Email给入境时的CBP Office，也可以试试 Local CBP Office，问问能不能把
I-94过期时间改成和护照一致（只说你要Renew H1B）。如果都不成功，看看能不能先
把护照更新了，拿新护照再去Local CBP Office试试。最后的办法就是出境再回来（墨
西哥、加拿大都可以）。

拿到新护照以后可以去CBP更新到和I-797一样的日期

其他几个回复都不对的，cbp给你到护照过期日已经是多给了，理论上cbp应该给到护照
过期减6个月。现在国内的CBP Deferred Inspection早就是只修改错误，不延长i94了
，就连墨西哥加拿大边境的i94 office都不会延长，要让你出去一下再回来才行。你去
联系cbp有风险，他们可以把i94缩短到护照过期日减六个月，你就sb了…


这是绝对的正解 联系cbp或者去海关 机场都有非常大的不可逆转风险 赶紧想办法拿护

You must deal with USCIS.

You and/or one or more of your dependents have been admitted to the United States
as a non-immigrant in the appropriate classification.  However, the admission has
been limited to the expiration date of the current passport(s), or until a date
that is six months prior to the expiration date of the passport(s) or intended
period of admission in question, in order to avoid a potential inadmissibility
into the United States under section 212(a)(7)(B)(i)(I) of the Immigration and
Nationality Act, as amended.  That is a lawful and correct admission into the
United States, and does not constitute an error.   At some time prior to the expiration
date of the passport(s), it will be necessary to renew the document(s),
or have it/them extended by competent authority of the country of issuance.

In order to obtain the time that could have otherwise been granted to the person(s)
affected, there are two options available.   
The first is to make a new application for admission into the United States,
and present ALL passports, visas, petitions, certifications, Notices of Action,
or other relevant forms.   

A trip to foreign contiguous territory for less than 30 days without a new visa or
other substantive change in status may result in a revalidation of the current status,
and a new I-94 will not be issued.  The passport(s) are generally not stamped.
  When a person is an applicant for admission, a new I-94 is issued and the passport is stamped.

The second option is to file the appropriate forms and applications with United States
Citizenship and Immigration Services. (USCIS) in order to request an extension of stay.

If an extension of stay is granted, an I-94 will be included on an I-797 Notice of Action
generated by USCIS. It will be the I-94 of record during the period of presence in the United States.
It will not be available on the cbp.gov website, even if the record number is unchanged.  

An electronic record cannot be updated to reflect an extension of stay.  Those records are only
issued by CBP/Inspections.   Please note that a new application for admission or possible
re-validation of current status will still oblige an alien to comply with current passport,
non-immigrant visa, and other admissibility requirements for admission into the United States.

Deferred Inspections

再次提醒一下大家找cbp风险大，没有把握前，不要轻易把护照信息给出去，因为好几个被往前改的。
除非是CBP的错误，基本上不可能改的。再就是NPT申请自己和公司还是要提交support letter。
我听说的另外一个成功的烙印也是提交了support letters。虽然有些律师会说这个没用，但肯定没坏处。

对的 应该是需要有valid的visa。我去的美墨边境的CBP有个专门的I94 permit office. 地址是： 2500 Roll Drive, San Diego, CA。

楼主，我去年也是遇到了一样的情况。因为上一次入境护照快过期，I94只给到了护照过期的日子。发现是因为要给H1B延期，律师要我提供I94的信息。当时已经过期了，去了CBP求更新I94，没有同意，也差点被往回调时间。最后还是赶在H1B过期前回国重新面签的。我因为这事自己付钱咨询过几个律师，楼主最好也自己问问律师。Bless!

补充内容 (2020-6-24 11:49):
楼主的I797还没有接近过期吧？我当时把所有能想的办法都想了，有律师还建议过去加拿大，然后入境美国希望CBP能以humanity 的原因(娃在境内）让我进来，然后更新I94。我当时I797就要过期，如果回国没有能及时签出来公司就没办法帮我Renew签证，我会失去工作，所以不到万不得已真的不想回国重签。但事实上，综合公司的律师和我自己的几位律师意见，回国是必须的，当时几乎是抱着回不来的心情回去的，幸好后来的一切都比较顺利。说这么多，是想告诉楼主千万别等到I797快过期再弄这个，I94也非常重要，尽量避免accumulate illegal stay。现在因为疫情回国变很麻烦，不知道有没有可以网开一面的做法，除了公司律师，也可以在Avvo 上找律师问问

我个人认为： （Disclaimer： 个人观点，每个人的case请自己咨询公司的律师）

1. 美签无效的话，是没法用automatic re-validation 通过去墨西哥回美国，来达到更新I-94的目的。
2. I-94过期，H1B visa stamp过期，如果打算通过H1B签证并更新I-94， 只能回home country 签证, 不能去第三方国家签证。
3. CBP 最近看到被西雅图遣返的，或者往前改的，律师建议我不要去CBP DIS office 即使有律师陪同。
