USCIS intends to begin implementing, through a phased approach, premium processing availability of Form I-539, Form I-765 and Form I-140 in fiscal year 2022. USCIS will also adhere to the congressional requirement that the expansion of premium processing must not cause an increase in processing times for regular immigration benefit requests.

USCIS Premium Processing Final Rule for Green Card, Visa & EAD published by USCIS is not going to be available until fiscal year 2024 or 2025.
Immigration experts are in deep shock, to hear the slow pace & delay by U.S.C.I.S, to not implement these rule for premium processing for certain forms until 2025. For your information, these rules were initially proposed in 2020 and published in federal register after two years in 2022. so U.S.C.I.S takes 2 years to Finalize the rule, and another 3 years after that to start implementing it.
A U.S. Citizenship and Immigration Services final rule, that would expand premium processing to include additional case types, has cleared the Office of Management and Budget, published in Federal register and implemented as law. but when it will come to effect?
Currently, premium processing is limited to certain Form I-129 nonimmigrant worker petitions and certain Form I-140 immigrant worker petitions, with a 15-day adjudication timeframe.
The revised fee schedule and timeframes set forth by the October 2020 legislation are as follows.
i-140 for Most forms, including EB1, EB2 and EB3 will be processing in 15 calendar days, with a Premium Processing Fee of $2,500.
i-140 for EB1 Multinational Manager, EB2 National Interest Waiver, EB2 Physician will be processing in 45 calendar days, with a Premium Processing Fee of $2,500.
Form I-129 Nonimmigrant Worker Petitions will be processing in 15 calendar days, with a Premium Processing Fee of $2,500.
Form I-539 for Change or Extension of Status, to F, J or M will be processing in 30 calendar days with a Premium Processing Fee of $1,750.
