换工作了, 重头开始 pwd, perm, 140 现在要多久啊? 20 年 3 月的 pd 能赶上吗?

我看了下最近 pwd 都要 8, 9 个月了?
再加上打广告 2 个月,
perm 现在是 1 年么? 如果被 check 算 2 年?
140 到时候可以 pp 算 1 个月.
是不是加起来保守估计要 3 年 了?

20 年 3 月 的 pd 赶得上吗? 谢了~

ps: 楼主其实还不知道怎么说服新公司入职就开始办 pwd 这些, 特别是最近 layoff 的情况, 可能不太愿意现在就办.

很多说 pd current 有 140 能够续 h1b 1 年, 这种说法是不准备的, 因为给不给你 transfer 或者续要看具体的律师, 比方这个帖子的例子, https://www.1point3acres.com/bbs/thread-790036-1-1.html, 别人律师说不行不给你办, 最后也只能回国了. 根据很多个不同的帖子的总结, 楼主得到的结论如下: pd current, 要续 h1b, 1) 要么 file 了 485 pending, 2) 要么file 了新 perm 超过一年. 其他即使能过也可能是 ymmv 的情况, 也会遇到雇主不愿意冒风险的情况, 所以上面两个条件对于换工作的小伙伴要注意, 不要再认为 pd current 有 140 就能续 一年了.

However, USCIS may excuse a failure to file in its discretion if the H-1B worker establishes that the failure to apply for adjustment of status was due to circumstances beyond his or her control.
Where the adjustment of status could not be filed because the H-1B worker is no longer with the original sponsor, it will be up to the discretion of USCIS to decide whether this qualifies as a circumstance beyond the worker’s control in order to grant a one-year H-1B extension. It may be helpful to document the steps the new employer has taken to file a labor certification on behalf of the employee.

情况 3) 就是要证明没提交 485 是 out of your control, 这也许是很多 140 pd h1b 延期1 年说法的由来, 但是也是 ymmv, 由 uscis 决定. 有明确规定的就是上面 2 个情况, file 了 485 pendin, 或者有新 perm file 超过 1 年.

所以实在是没有 485 pending 或者 perm file 超过 1 年, 就靠 ymmv, 找新雇主, 他们愿意给你 file h1b transfer 哪家过了就去哪家也许是唯一的选择了. 或者你留住原雇主, 让他们提供 out of control 的证明来 complete uscis 一下

是的，所有重新来，除非 batch perm

有说貌似 pd current, H1B只能延期1年，并且只能延期1次，除非有pending的485。如果没有在1年之内上交485，且如果H1B已超过6年那么将不能再延期，也就是说会丧失在美国的H1B身份, 除非能证明没file 485是out of your control

也有说 pd current 也能继续 extend, 但是要打破6年的cap你在申请extension的时候必须得有Labor Certification Application且filing的时间已经超过365天。据我的了解PERM是一种LC.

20 年 3 月的 pd, 差不多 2024 下半年 2025 财年左右就 current 了吧

刚进公司就想办140，现在经济不好，有工作就很幸运了
