求助：CAP-GAP结束后H1B被拒，有多长时间可以准备离境

我OPT 6/30/17结束，然后CAP-GAP到9/30/17，9/29号收到RFE，12/19 USCIS收到补件， 现在还在pending。 假设我2月被拒，那么我有多长时间准备离境？

我之前一直以为是60天grace period，但是我问了律师，他说只有10天，因为CAP-GAP过期而grace period是针对在CAP-GAP被拒的人的。（原文链接在下面）如果是只有10天，来得及办留学证明这些东西么？

"If an H-1B petition filed on behalf of an F-1 student covered by Cap-Gap is denied, rejected, revoked, or withdrawn, the student will have the standard 60-day grace period (from the date of the notification of the denial, rejection,  revocation, or withdrawal of the petition) to prepare for and depart the United States."

"Once a timely filing requesting a change of status to H-1B on October 1 has been made, the automatic Cap-Gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension of status will continue through September 30. If the student’s H-1B petition is denied, withdrawn, revoked, or is not selected, the student will have the standard 60-day grace period from the date of the rejection notice or their program end date, whichever is later, to prepare for and depart the United States."

我觉得是最多十天。。因为cap gap 期间 （10月1日之前）楼主的sevis 还是active 的 被拒之后按照学生申请h1b 被拒 有60天的grace period。也就是楼上所说的。 10月1日之后sevis 还会保持60天也就是到11月31日。 这段时间被拒 有争议。但我认为还是按照学生被拒有60天 这样来看， 毕竟只要sevis 还是active 就还是f1.

但是11月31日之后被拒。你等于是在无身份的时候被拒。之前的身份是空的，空身份期间被拒，也就没有60天的grace period。11月30日 我和很多申请h1b 的小伙伴都确认了下，确实大部分人11月30日sevis 被自动停掉了。所以我认为11月30日之后没有60天。只有10天让你离境。

至于楼上贴出的原文。这个应该是针对cap gap期间的问题。因为通篇都是f-1 student 要怎么怎么样。问题就是11月30日 sevis 一停。 应该就不是f1 student了。

这是我的理解。仅供参考。不能保证完全正确，但保险起见，按照10天离境比较好。。
