求助！公司说h1b抽签过程不能出国

lz两周以后入职，今天收到公司immigration team的邮件说了一些h1b的事宜，其中提到一条

• You must be physically present in the United States from the time Apple’s H-1B Cap petition is filed with the USCIS until the H-1B petition is either approved, or rejected as part of the lottery process.
  

但是我今年八月底-九月初要回国半周~一周左右办一些非常重要的事情，没有办法取消这个行程。请问各位前辈们，在h1b抽签过程中回国会有什么影响吗？是硬性规定不能回国吗？
最坏情况下，如果因为我这次回国影响了今年的抽签，会影响明年的抽签吗？

确实很麻烦，如果这段时间回国，即使抽中，也被approve了，但在10月1号之前离境，想回来需要用其它签证，这说明你abandon your change of status,而且必须在10月1号之后再次出境，取得h1b visa 之后才能激活h1b，也就是那时才可以工作。但如果抽中，还没有批准，就更麻烦，一旦离境，要是需要补材料，人不在很不方便，而且想再次入境，需要必须有其它valid visa，比如F1签证在有效期内。如果抽中，但在回国期间被denied，一样的，只能用其它签证回来，否则就回不来了。

所以总结来说，除非有其它的有效签证，否则如果没有去使馆取得h1b 签证，都有可能回不来了。

risk很高，基本上律师都不建议这么做。

如果选择notify的话就不是10月1日马上转身份了，只要你不激活就不是h1b，也就不存在10月1日马上不能工作的说法了

如果真那么重要的事情需要离境，也不会有问题，只是麻烦一些。你那个时候抽签已经结束了，如果抽到的话只是离境会导致境内转身份失败，在approve之后你要再出国重新面签转身份，但你哪怕境内转成了，你回国还是要面谈拿visa的，所以我自己看来其实都是要专门出去一趟搞签证。
如果你在回国前approved了，可能就可以直接回国办事加办visa了（这个到时再和律师确认下，我也不百分百确认10月1前可以办签）。 你现在并不用着急，先抽，抽完等approve，邻近回国还没approve，就联系律师告诉你的提前回国决定。

We do not have any updates on your petition yet.  It is still in process.  So, if you travel, you will need to talk to your university about ensuring that your I-20 is endorsed for travel before you leave and take any other steps that the school recommends before booking your travel.

Please note that if you travel, you will be considered to have abandoned your request to change your status from F-1 to H-1B.  The H-1B petition (establishing that you are eligible for H-1B status) will continue to process, but if it is ultimately approved, you will have to depart the U.S., apply for an H-1B visa, and return to the U.S. in H-1B status before the change takes effect.  If you remain in the U.S. until the petition is approved, you would not have to depart the U.S. after the petition is processed.  So, it would be an additional step if you leave while it is still pending.

Please advise what you ultimately decide to do, but hope that information helps you make a decision.

Traveling in such instances is not advisable.  If you are applying to change to H1B status from another status, then traveling outside the U.S. will abandon your request to change to H-1B status.  If the H-1B petition is later approved by USCIS, you will need to apply for an H-1B visa at a U.S. consulate before you can enter the U.S. in H-1B status.  If you must travel, you can request premium processing for your H1B application.  With premium processing, USCIS will adjudicate the application within 2 weeks for an additional fee of $1225.  This way, you can hopefully have your H1B approved prior to traveling.

If our office filed a change of status petition for you:
You must not travel outside of the U.S. while the petition is pending. Leaving the country while USCIS is reviewing your petition will cause USCIS to consider your petition for a change of status to be abandoned. Your underlying H-1B petition may still be approved, but you would have to depart the U.S. and apply for an H-1B visa abroad to re-enter the U.S. in H-1B status before you could start your H-1B employment.
Once USCIS approves your change of status petition, you may travel internationally. Your H-1B status will take effect on the date that was requested.
While travel, as outlined above, is permissible, you may encounter difficulties when re-entering the U.S. or when applying for a visa for your current status. Therefore, we recommend that you do not travel internationally from the moment your department starts the H-1B process with our office until your H-1B status takes effect.

请问如果选择了change of status，10月1日自动激活h1b身份，那么如果年底回国的话也是要签证的吗？

我也觉得，申请期间离开美国，应该也只是影响cos的批准吧，可以问问律师这种情况是不是直接申请consular processing更好啥的

貌似h1b抽中到批准之间回国会导致change of status失效。。仅此而已。。

假设lz的回国安排不需要重新签F1，那么楼主可以要求公司提交申请类型为consular processing，然后回国行程改为回国签h1b，并在国内待到9月30，然后以h1b签证入境工作。你回国这多于一个月时间内公司是否允许你远程工作，或者是否可以休带薪或不带薪年假， 是公司政策。注意，如果你拿到h1b并在10月1号前入境，那么入境后到10月1号之间不能工作，必须unpaid leave

如果公司仍然提前change of status，那么假设楼主运气好，在回国之前h1b被批准，那么你回国再回美国应该仍然可以在10月1号h1b身份直接生效。如果运气不好，在回国之前h1b没有被批准，那么。。。无论什么时候h1b被批准，change of status都会被deny，需要在opt失效前h1b生效后回国签证以h1b入境美国。假设楼主运气像我一样差，h1b抽不到。。。那就没有任何影响
