H1B, S386与AC21

好奇点进去连接看了以后, twitter作者给出了法律原文如下(https://www.uscis.gov/sites/defa ... 08/ac21_30may08.pdf):

Pursuant to AC21 §104(c), an alien is eligible for an extension of H-1B status if the alien is the
beneficiary of an I-140 petition and would be eligible to be granted immigrant status but for the
application of per country limitations applicable to immigrants under INA § 203(b)(1), (2) or (3).
Despite the title of AC21 §104(c), referring to “one-time” protection, USCIS may grant such H-1B
extensions, in a maximum of three year increments, until such time as the alien’s application for
adjustment of status has been processed and a decision made thereupon.
AC21 § 104(c) is applicable when an alien, who is the beneficiary of an approved I-140 petition, is
eligible to be granted lawful permanent resident status but for application of a per country limitation
to which that alien is subject or, alternatively, if the immigrant preference category applicable to that
alien is, as a whole, “unavailable”.

大致上是说, 如果你想拿六年后的三年H-1B Extension的话, 有这么几个条件:
1. 你的I140已经批准, 现在正在等排期
2. 这份申请必须是"the application of per country limitations applicable", 就是必须是有国别限制的(重点)
3. 你的EB是1,2,3类

然而很遗憾的是, 这次的HR1044/S386拿掉了"per country limitations"却并没有有关AR21的amendment. 也就是说, 假设HR1044/S386以现在的形势通过, 而且很不幸从H-1B开始的六年之内没有拿到绿卡熬到了Extension, 之后的H-1B延期就只能一年一年的延期, 而并非像现在一样三年三年的进行. 现在H-1B的RFE和Denial又节节攀升, 这又无形的对于留美增加了很多变数. 给大家作为参考, 毕竟排期只是一个方面, 还要看对H-1B以及自己身份的影响. 说实话我其实没想到还有这种操作...

我去, 要是这样岂不是直接飞天...那这不是给后面的人挖坑吗...

我一直以为现在就是一年一年续的。。。居然是无限续3年啊

我可能记错了，但是我理解是如果没有ac21和cap，h1b六年一到必须走人

对, I140批准了以后是三年无限直到排期current

是吧, 我也觉得操作太骚了...没看出来还有这样的
