section 6.7 of the ICE policy guidance

OPT may work full-time in a field
related to his or her degree; may apply

for the Cap-Gap extension.103 As noted
above, however, such a student would
be eligible for a STEM OPT extension
only if that extension is based on the
same STEM degree that is the basis for
the student’s current 12-month period of
OPT. A student who is on a 12-month
period of OPT based on a non-STEM
degree and who seeks a STEM OPT
extension based on a previously earned
STEM degree must have completed all
requirements for conferral of the STEM
degree—including any applicable thesis
requirement (or equivalent).

我两年前phd quit，研究过这个。可以告诉你的是，我的结论是phd quit基本没办法工作的，post opt你这种情况不适用，只能再读一个ms（如果你没用opt），不然就没法子了。
说实话，每年很多phd quit，如果你这样子可以解决，那大家都来地里报DP了

我的老板确实是美国人

这种类型的OPT 申请（我们学校叫OPT based on coursework)和你之后会不会完成thesis或者拿没拿到degree应该没关系。只要完成了degree plan里的课程并且是phd candidate就可以申请。一旦你工作了，公司也不在意你的phd degree，让公司帮你用master的degree申请H1B，这样你就可以不用管phd的degree了。这是我的理解，你可以先和学校咨询好，保险一点再找个律师咨询一下。祝好运！

我的经历和LZ有点类似，当时我们phd项目也是上满多少门课就可以拿ms。第一年结束系里发邮件说大家可以申请ms时我没有马上要，不曾想过了三年quit的时候用这个迟到的ms学位申请的opt

一个学历就一个opt。Master的用过了，phd的drop off的话，是没有OPT的。要留美找工作的话，这么几个选择：
1. 找非营利性机构的工作，他们办H1B一般很快。
2. day 1 C

你这quit得太迟了。OPT只有Master毕业前后几十天才能申请的，你这已经两年过去了，而且PhD又没有拿到，OPT这条路是走不通的。

续楼主问题，如果拿过PhD转码读MS，MS读不下去也不能重新用PhD的OPT吗

和你有过一样的经历和思考，结论是不行。master学位clear之后三个月内不申请OPT就不能申请了。解决方案，如果你没clear master学位（这是给后来学弟学妹们看的），尽量拖着不clear，比如缺一门核心课就是不修，否则coursework达标了，研究生院会发现，可能会强制帮你clear这个学位，我当时的情况就是这样。如果已经clear了，查查学校有没有免费的master二学位，在PHD奖学金能撑多久撑多久的前提下，多修课，最后拿master二学位申请OPT，当然以你的情况最后自费一两个quarter也是有可能的，做好各种心理准备。希望对你又帮助，缺米缺米～～

有些是可以的，没有什么法律上的阻碍反正，但公司政策可能不允许。
