【新的immigration bill来了 - EAGLE Act】post-S386?

1. A bipartisan bill will likely be introduced today that seeks to eliminate per country employment-based immigrant visa caps
2. The bill will be introduced by House Immigration Subcommittee Chair Zoe Lofgren (D-CA) and Republican Representative Curtis
3. It picks up where S. 386 was with the Durbin fixes from last year WITHOUT the nefarious anti-Chinese provisions added by Senator Scott of Florida
4. The bill will be called the Equal Access to to Green Cards for Legal Employment Act of 2021 (the EAGLE Act)
5. Eliminate EB per country limits with a 9 year phase in, 5.75% reserved for consular cases for 9 years and 4K visas reserved for nurses and physical therapists.  
6. It will Increase family per country limits to 15% which will dramatically shorten the waits for Mexican nationals who face much longer waits than other countries
7. There will be new restrictions on H-1Bs including some more enforcement provisions. I am not thrilled about this language either, but it wouldn't be enough to dissuade me from overall support (as they say, the perfect is the enemy of the good)
8. The most significant provision we got from Senator Durbin last year was the addition of a provision allowing for early adjustment filings for most nonimmigrants to file after their I-140s have been approved for at least two years. That's MASSIVE
9. The bill is also delayed from being effective until the 1st day of the second fiscal year after enactment.
10. Between the 9 year phase in, the two year delay in the effective date and the early adjustment language, the bill sponsors have really come a long way to try and make the transition to the new system as pain-free as possible for rest of world countries in my view
11. Unless Republican support can be found in the Senate, I'm not sure the bill can move.  It would depend on whether there are 60 Senators who will support. Maybe they're out there.  But we seem to be moving in the wrong direction from last year
12. BUT - This bill is probably not moving so I'm not going pretend otherwise. That's because Senator Lee is apparently backing away from supporting the bill and Senator Scott is likely going to strongly oppose without his provision.


目测这个bill的最终结果:  House (can be easily passed by single marjority)  -> unanimous consent IF introduce Senate's own version (Like S386) --likely failed  or go through Senate Judiciary Committee (likely passed  *chair is Durbin*)  ->  Sent to Senate Floor for full vote (need 60 votes to pass)

--目测会有人各种方式阻拦，比如 filibuster, poisoned amendment, etc.    简单来说，很可能像S-386一样在 参议院扯皮 最后 胎死腹中.. 毕竟明年midterm election..

最后晃了一圈就像S386一样，画饼利益冲突悬殊，不了了之..

所以 大家该吃吃，该喝喝，该排队的 请继续等待，围观群众就行了，完全没必要去 advocate像 反S386/支持S386一样，政客的玩具不是普通人可以玩的)。。

这个bill长期对中国算是好消息吧。虽然最大受益显然是印度，中国只是捡捡芝麻。

按说九年缓冲期对大陆是利好。要说利空，就是那个scott条款会不会重新被放入？更进一步说，在目前的中美形势下，民主党有无必要拦住scott？说到底，回到了论坛的老问题，团员算不算affiliate？

眼下排期飞速前进，烙印动力也不足了
