我觉得有一个很重要的论点是OPT是针对于学生的,而大家都知道国际学生的学费很多时候要比美国学生贵好几倍,还没有资格申请学生贷款,所以在美国自费读书的家里一般都是有一定经济实力的,不是一定要费劲一切手段在美国做牛做马拿最低的工资也要留在美国苟且的悲惨人士。。。所以OPT学生那低工资从动机上来也是说不通的。这跟现在一些H1B作弊者有很大的不同。全奖来的那自然都是人中龙凤,说什么美国都有义务保护。

Thank you for your advice. I can see that you really spent time in doing research for immigration status issue. But I would like to be clear that you understand these:
"There are a lot of Indian outsourcing firms(far more than the number of large companies which are willing to give high salaries to foreign students) who preferentially recruit foreign students on OPT or import foreign workers on H1b to serve as consultants. These consultants do very basic and cheap contractor work for US IT companies."


--- I admit this is a legal loophole in H1B visa. I guess DHS didn't realize these Indian firms will make every effort to push the consultant to abuse H1B, by filing many comanies for one person. This loophole incurs the exponential growth of technical immigrants who do not have a degree in US, and many talented students not able to apply for H1B and GC to stay in US due to limited quota, and that's why DHS never erged to increase the quota.  But anyway, this has nothing to do with OPT, for OPT is only for US graduated foreign students.


For your second argument, if there were no market for contractors, these firms wouldn't survive. Almost all big and medium companies including FLAG are hiring contractors to save money and avoid legal risks. OPTs and H1s should find a position in any of the companies so that the firms can earn profits. Contractors are paid the same as employees and only lack benefits, and more importantly, hiring by contract does not distinguish working status since it's temporary. In fact, many STEM engineers who are US citizens are contractors. On the other hands, contractor work may not be basic. Again, why should an e-verified company (A promise for OPT extension) pay for a foreigner who has more status instability, higer legal risks, and less fluent English with high salary? Think about it.

---- Education is a complex and very long-term issue. As I see US government does spend much on education (at least comparing to China). Foreign students pay 3x higher tuitions than in-states in public school, and I believe the money mostly will be eventuallused for education. The biggest beneficiaries are American students since they have overwhelmed advantage in population. And I do think American students do not perform good at mathematics, which is the foundamental skill for STEM positions. SAT and GMAT quantitative is just Chinese's secondary school level difficulty. I think that's a reason local stem workers are not so competitive.


I do understand your complain and anger, but does it make sense? You cannot block us forever. Americans, you got to compete!

I believe talented foreign students should stay in US but I do not believe the prevailing abuse of current OPT regulations really helps retaining talented foreign students. . 1point3acres.com

But I believe there is common ground and I post my comments to the OPT extension rule about how to improve the new rule to protect US workers legitimate rights

1) very clear and high enough prevailing wage requirement for employers to recruit students on OPT
2) set up a black list of companies that abuse OPT and H1b, those in black list will be forever barred from using OPT or H1b program.
3)OPT program should only be available for students from top 50-100 US universities, the current provision "accredited Universities" is too vague.

I suggest you post what you said to me in your post to the comment section as well and also encourage Chinese students to comment about how to improve the OPT extension rule to achieve a balance between rights of US workers and rights of foreign students.You will never be able to convince those radical racists but if more and more chinese students think about how to achieve this balance, you will win support from at least part of the US public. From 1point 3acres bbs

今天跟几个STEM美本菇凉聊起来,发现她们都对这整个公示过程存在误解,还“安慰”我说你想多了吧,不是之前已经批下来了嘛。

她们也是留学生,也是想在美国找工作的,是OPT extension的直接利害人,所以我不认为她们是真的不关心这次公示。剩下的只可能是因为对政策和相关流程存在误读。之前提出OPT extension 24个月的时候,不少网站,公众号,还有留学机构都当做重大利好来拼命宣传,而对之后的公示流程和不被通过的风险避而不谈或者一笔带过,现在造成了一部分人误认为可以安心等法案通过,躺着收OPT extension。当然我的sample size只限于身边的人,可能并不具有代表意义。但如果真的有一些人是因为被之前的盲目利好误导,才没有去提交评论的话,我们岂不是白白损失了一大批和我们站在统一战线上的战友们?恳请版主大大和各位牛人们写一份解释宣传稿放到公众号上,通过朋友圈的大批转发,让大家真正看明白这个流程和其中的种种风险,调动更多人去把评论顶起来!

It should be well-accepted that the U.S. economy could use more workers with high levels of knowledge in science, technology, engineering and mathematics. The shortage of these skilled STEM professionals eased during the recession, but by any conventional definition, now it appears to have returned.
For one thing, wages have grown relatively fast in most STEM-oriented occupations, which is a clear indication of a shortage. From 2000 to 2013, analyzing Bureau of Labor Statistics data and adjusting for inflation, median salaries for workers in computer and mathematical, health care practitioner, engineering, and science occupations rose 8 percent, 7 percent, 6 percent and 5 percent respectively, even as those for the average U.S. worker showed no growth. Software developers, for instance, saw salaries soar 26 percent over the same period, culminating in an average of $82,000 in 2013, up from $48,000 in 1980. More broadly, an analysis I completed earlier this summer for the Brookings Institution of census data showed a large relative increase in the STEM earnings premium – about 60 percent – from 1980 to 2012, controlling for education, experience and gender.

I feel like there is a lot of misinformation in the comments with regard to this proposed rule, and I would like to correct some of it while explaining why this rule is not just a good one, but it's absolutely essential for improving the US economy. Please note that I'm speaking based on my experiences as a recent Statistics graduate (M.A.)..google  и

First of all, the OPT does not take jobs from qualified Americans. There are many, many reasons for this,and it's difficult to describe them all.

* Companies have a very strong preference for domestic talent, due to language issues, visa issues, and cultural mismatches; thus an equally skilled American worker will ALWAYS win over a foreign worker (in fact, even a significantly less skilled American can often get the job).

* There aren't enough Americans in post-graduate education, and the ones that are are simply not as talented as foreign students. There is a flagging domestic interest in STEM postgraduate degrees -- in 2015, less than 50% of postgraduate STEM degrees went to American citizens, according to the Pew Research Center. For many schools, the actual percentage is much, much higher. In my department, 80% to 90% of students were foreign. If you think the solution is for schools to hire more domestic talent, then know that in my cohort, my school had 20 domestic applicants and 220 foreign applicants. It's much harder to get accepted as a foreign student and thus the foreign students who do get accepted are better. Thus, it's clear that Americans (at least in my field) simply aren't chasing the post-graduate education that many employers need. Foreign students are fulfilling a need for skilled workers that Americans cannot supply by themselves.

* The opt only lasts 12 months, and the proposed rule allows for a 17 month extension for STEM graduates only. This is less than three years, not a long time from the perspective of companies. In order to retain workers hired via OPT, they need an H1-B visa, which is expensive and limited, and requires that no qualified Americans apply for the position. For this reason, many companies don't seriously consider OPT candidates that will eventually require a visa sponsorship, unless they have no other choice.

A close look at the job search shows how much companies favor Americans. After graduating, I applied to about 30 jobs before I got an offer. Based on communications with foreign students, I would estimate that, on average, they submit about 200-500 applications before getting a job, and 1000+ is not uncommon. These are graduates who are as talented, if not more so, than myself.

So foreigners are not taking our jobs. Why do we need this rule? The reason is we need this talent. We trained them in America, and they are reaching the highest level of education that we offer. America has spent a lot of time and money developing their talents. Most importantly, they overwhelmingly WANT to be here. They wish to work in America and contribute their considerable skills to the American economy. A great many of them (a majority?) wish to immigrate. This rule really does help America's best and brightest, our smartest and most talented workers who will contribute to the US economy. Why, oh why would we kick them out?!

PLEASE allow this rule to take effect. This rule is a major step forward to improving immigration and improving the US economy.
