OPT即将到期 H1B还没消息 求助。。。

走投无路了 来地里求助大家
我是商科专业 去年毕业
去年公司开恩 让我毕业前（修够了学分但是还没拿到毕业证书）抽了一次 但因为这个 我的OPT从四月底就开始了
因为去年没抽中 今年继续 至今还没消息 （哭。。。）
最大的问题是 我的OPT下礼拜就到期了 现在HR坚持说我从下周OPT到期之后就不能工作了 除非在这之前想到Plan B（譬如转成CPT）
可是 我一直以来的理解是  OPT到期和你确定知道H1B没抽中 这两者之间 选晚一点的那个日期开始 才是你不能合法工作的日期  否则现在如果我H1B中了 只是因为还没通知到律师  我依然不能工作了吗？

向大家说一下进展： 昨天跟学校联系，学校帮我把I20延长到了六月2号，这样我可以工作到H1B有确定的结果，而且同时也可以思考Plan B。希望对有相同情况的小伙伴们有帮助！

在OPT有效期内申请H，则在H有结果之前以及获批准的H工作之前，可以继续OPT工作。
如果在OPT结束的grace period期间申请H，则不能工作，只能合法居留。
只是自动延长你申请H时的状态。
所以能不能工作取决于你申请H时的OPT是否有效。

你理解得对，HR不懂。在最后结果出来之前，OPT自动延期。

How is the cap-gap situation changed under the interim final rule?
•        F-1 academic students on post-completion OPT maintain valid F-1 status until the expiration of their OPT. Once that OPT has ended, they are authorized to remain in the United States for up to 60 days to prepare for departure.
•        Under this rule, the F-1 status of students is automatically extended when the student is the beneficiary of an H-1B petition for the next fiscal year (with an October 1 employment start date) filed on his or her behalf during the period in which H-1B petitions are accepted for that fiscal year.
•        The automatic extension terminates when USCIS rejects, denies, or revokes the H-1B petition.
•        If the H-1B petition filed on behalf of the student is selected, the student may remain in the United States and, if on post-completion OPT, continue working until the October 1 start date indicated on the approved H-1B petition.
•        The student may benefit from this provision only if he or she has not violated his or her status.

为了给公司一个证据，可以凭邮寄H申请文件的邮局手续，到学校申请一个OPT延期到6月1日的I-20。期间如果抽中了，凭批准文件，申请延期到9月30日。

Proof of Continuing Status

The cap-gap extension of OPT is automatic for eligible students. A student does not file an application for the extension or receive a new EAD to cover the additional time. The only proof of continued employment authorization currently available to an affected student is an updated Form I-20 showing an extension of OPT, issued to the student by his or her DSO. This document serves as proof of continued employment authorization.
If a student chooses to obtain an updated Form I-20, the student should go to his or her Designated School Official (DSO) with evidence of a timely-filed H-1B petition (indicating a request for change of status rather than for consular processing), such as a copy of the petition and a FedEx, UPS, or USPS Express/certified mail receipt. The student’s DSO will issue an updated Form I-20, showing an extension until June 1.
If the H-1B petition is selected for adjudication, the student should return to his or her DSO with a copy of the petitioning employer’s Form I-797, Notice of Action, with a valid receipt number, indicating that the petition was filed and accepted. The student’s DSO will issue another updated Form I-20, showing an extension until October 1. In such situations, the student can continue to work while the update to his or her Form I-20 is being processed. Because the Cap-Gap extension is automatic, the updated Form I-20 is not required for a student to continue working; it merely serves as proof of the extension of OPT employment authorization.

HR 不一定懂，问律师吧。而且不是有个Grace period？ 不过不知道是不是指能留美国但是不能工作。。

楼主按道理说你不是自动延长OPT么，cap-gap？直到一个时间节点，例如收到退件啥的？然后你赶紧积极准备backup plan，明年再抽？

你应该问下学校ISSO，让ISSO办一个cap-gap之类的。

工作肯定是 OPT 到期就不能再做了，除非 H1B 抽到了，这个时候就变成灰色区域，可以继续工作到 H1B 生效；当然，不能工作，不等于你不能在美国再留一段时间

Are you sure?

If H-1B petition is only selected from lottery, the student still need to be on OPT for being eligible to work.
If H-1B peition is approved. the student will be eligible to work until Oct 1, if the student was on OPT the moment s/he applied H-1B.

Just my understanding.
