现如今我也终于找到一个公司乐于sponsor我的visa
对于不是IT 专业 属于生物农业专业的非phd找到小公司 然后对没有办过H1B 的小公司解释sponsor这个过程 我还是下了一番功夫 我当时准备了一些资料 并且对于不找律师自己DIY的package 也做了一些的介绍。

1. What is H1-B:
The H-1B is a non-immigrant visa in the United States under the Immigration and Nationality Act, section 101(a)(15)(H). It allows U.S. employers to temporarily employ foreign workers in specialty occupations. If a foreign worker in H-1B status quits or is dismissed from the sponsoring employer, the worker must either apply for and be granted a change of status to another non-immigrant status, find another employer (subject to application for adjustment of status and/or change of visa), or leave the U.S.

• Must have an employer-employee relationship with the petitioning U.S. employer.
• An H-1B visa number must be available at the time of filing the petition.
The H-1B visa has an annual numerical limit, or cap, of 65,000 visas each fiscal year. The first 20,000 petitions filed on behalf of beneficiaries with a U.S. master’s degree or higher are exempt from the cap. Additionally, H-1B workers who are petitioned for or employed at an institution of higher education (or its affiliated or related nonprofit entities), a nonprofit research organization, or a government research organization are not subject to this numerical cap. Cap numbers are often used up very quickly, so it is important to plan if you will be filing for an H-1B visa that is subject to the annual H-1B numerical cap. The U.S. government’s fiscal year starts on Oct. 1. H-1B petitions can be filed up to 6 months before the start date, which is generally April 1 for an October 1 start date. (All documents are recommended to be received by April 1).
Last year, April 7, 2015 USCIS announced that on April 7,2015 it has received enough H1-B petition to reach the statutory cap of 65,000 visas for fiscal year 2016. USCIS also received more than limit of 20,000 H-1B petitions filed under advanced degree exemption, also known as master cap.
USCIS received nearly 233,000 H-1B petitions during the filing period, which began April 1, including petitions filed for the advanced degree exemption. On April 13, USCIS used a computer-generated random selection process, or lottery, to select enough petitions to meet the 65,000 general-category cap and the 20,000 cap under the advanced degree exemption. USCIS will reject and return all unselected petitions with their filing fees, unless the petition is found to be a duplicate filing.

4. Application and Supporting documents from Employer:
• Copy of most recent federal income tax return or annual report.
• Copy of Form 941 Employer’s Quarterly Federal Tax Return for the past 2 quarters.

In order to prevent future denials on LCAs submitted with this FEIN (Federal Employer Identification Number), please submit one of the following documents that clearly displays the FEIN (labeled as an FEIN) and the name of the employer:
( • Documentation from IRS noting assignment of FEIN
• Documentation issued by the IRS or Federal tax return (labelled as FEIN, TIN, FID or any nine-digit number)
• Documentation from the State or State tax return specifically labelling the FEIN as a “FEIN”
• Official documentation from employer's financial institution, pre-printed and specifically labelling the FEIN as a “FEIN”
• Secretary of State registration indicating the FEIN in an official format and specifically labelling the FEIN as a “FEIN”

• Unemployment insurance documentation indicating the FEIN in an official format labeled FEIN, Federal ID, or FID
• Tax forms that are prepared, printed and signed by a Payroll Services Company that have passed the IRS Assurance Testing System (ATS) and/or Business Accepting Testing (BATS) requirements for Software Developers, Reporting Agents, and Transmitters of electronic business returns to the IRS do not have to have a preprinted label. It must be “signed” by the Payroll Company, and not an individual person.

• Fill out Form I-129 Petition, including the H Classification Supplement and the H1-B Data Collection and Filling Fee Exemption Supplement.
• Copy of passport biographic page, and all U.S. visas (valid or expired).
• Copy of the most recent I-94 card or online I-94 record (can be retrieved at https://i94.cbp.dhs.gov/I94/request.html).
• Copy of I-20s, EAD card (OPT), DS-2019, IAP-66, I-612, H-1B approval, H-4 approval, L-1 approval, L-2 approval, J visa waiver, and all USCIS I-797 approval notices and receipts if applicable.
• Copy of degree certificate and transcript for each degree obtained (bachelor, master, phd, etc.), with certified English translation if applicable.
• If degree is from a non-U.S. institute, please provide academic credential evaluation if available. .
