中了H1B会影响用OPT入境吗

我又来这里求问大家了。。。还没毕业的小白真是啥也不懂，求过来人指点。

我刚刚得知用本科学历抽中了H1B，目前master还在最后一学期，没毕业。我毕业之后，OPT开始之前，想离开美国出去玩一圈再回来。本来觉得那会儿拿着还有效的F1\I20\EAD\Offer Letter，入境就没问题了。可是现在又中了H1B，应该就是默认10月1日在美国境内自动激活的，但是我还不是百分之百确定，抽中的这个H1B不会影响我入境美国吧？

我知道这事儿应该问律师的，可是人家说最近弄H1B还挺忙的，如果不是urgent事情，最好先别去问。。所以想着来这里问问大家，多谢！！



再补充一下哈，我出去玩、再入境美国起码也得6月中旬以后了，那会儿H1B按正常应该approve了吧？

我们的律师和我们说过，这个时候最好别出去。当时情况是15年我同事抽到了，F1签证也过期了。如果你再进入美国的话就需要签证去申请的时候，可能就是H1B签证了，有可能大使馆办签证的时候就会让你10月1号正式开始的时候再去美国。中间就回不来了。但是这是2年前问的，现在如果你有5年F1签证可能也可以拿签证回来。所以最好问下律师

CHANGE OF STATUS – IMPACT OF INTERNATIONAL TRAVEL: Please note that traveling internationally while your H-1B change of status petition is pending, and, if selected for processing, before October 1st, (when approved H-1B petitions take effect) can pose significant risks and result in delays.  If you travel abroad while your H-1B change of status petition is being processed, the change of status portion of your case will be considered abandoned. USCIS could still approve the H-1B petition itself, but you would not automatically change to H-1B once the H-1B is approved. Instead, it’s likely that USCIS would approve the case for consular processing.  This means you would not be able to automatically switch to H-1B status while present in the US on October 1, 2017. Instead, additional steps would have to be taken to activate your H-1B status at a later date.  If your case is adjudicated for consular processing, you would continue to maintain your current status until your current status expires or you activate your H-1B status, whichever comes first.  

While we generally suggest that individuals with H-1B change of status petitions refrain from traveling internationally until after October 1, 2017, if you have an urgent need to travel before this date, we strongly suggest that you delay your international travel until your H-1B petition is approved. After your H-1B petition is approved, international travel may be okay as long as you have a valid passport, visa stamp, approval notice and latest paystubs.  If you are in F-1 status, you would also need your valid OPT EAD, and valid I-20 endorsed for travel at the time of your reentry to the US (you will need to check with your international student office on this particular issue to confirm).  Please see our note regarding Cap-Gap below if you have an OPT EAD or STEM EAD that will be expiring between April 1, 2017 and October 1, 2017.

好的谢谢提醒！我的F1签证还没过期，不存在申请F1签证的问题~

和楼主同一情况，EAD卡还没到手，还没入职呢，就抽中H1B了，这怎么处理？
