有大神预测一下大概什么样的case容易被拒吗？

昨天收到receipt了，现在就开始担心被rfe，担心被reject。
我是accounting+management的本科毕业现在在一家车行做accountant，但公司刚成立一年，然后我的实际工作其实远不止accountant，各种杂七杂八的奇怪事务有时候也是给我处理的…现在就有点心悸不知道会不会通过…
本科会比adv的难通过吗？公司规模小成立时间短会容易被reject吗？

If your employer sponsor is a small company or a start-up, it’s a little questionable whether the job is a specialty occupation, your education is kind of related but not an exact match, or you foresee possible job instability, you may need to be careful with your potential RFE.

level-1, CPT>12m, major not match the industry standard, working location at third party, vague job description, wrong application fee... etc

我觉得 还是要看你 交上去的 job description 毕竟移民局是不知道 你实际在干什么

请问CPT>12M到底是用什么理由RFE的呢？因为申请h1b用的是已经获得毕业证书的master, 所以不是现在再用cpt的那个学位，具体职位和学位的相关性之类的RFE都是围绕着上一个学位展开的，那么相当于我在上学并且同时实习，我实习的公司因为我的上一个专业的专业技能与职位的匹配而帮我file h1b并希望我去公司就职，那么跟我在当下学位“带薪工作”了多久有什么关系呢？
据我所知一般CPT被rfe都是在change of status情况下，因为境内直接转换成h1b, 移民局对于中间状态的衔接和合法性会质疑，但是如果是consular processing就不会，因为完全可以读完现在的学位再去让H1B生效。不好意思问题有点多，就是想知道真的有人被RFE是因为CPT超过12个月？感觉没看到过这个理由。。。

New Memo has been released this March.

"A student may be authorized 12 months of practical training, and becomes eligible for another 12 months of practical training when he or she changes to a higher educational level." -- 8 CFR 214.2(f)(10)

I see a lot of people using the same educational level CPT after they lose the lottery, (a few people tried 2+ schools). But I would say if they choose CPT program for their second graduate degree, there is a high risk for USCIS issue a RFE asking you why you join that school, what is necessary reason. You need provide your class details, explain connection between current job with curriculums, and your attendance rate, even your route fees.

I would say it's not wise to choose CPT especially you use day-1 CPT. Please be aware of that fact, this year, USCIS will select 100K people for review their cases. But at most only 65K will be approved, the estimation of approval rate will be 65%-70% (you know this is an optimistic estimate). So dont make any mistake, otherwise they will reject you by any sensitive issue.

This is tricky. The IO will ask you why a CPT coming after an OPT.

CPT are generally in between your studies, not after you graduate.


So you need to explain a lot on this if you get an RFE on this case, such as why you take a new degree, how can your new degree or curriculumns benifit your current job other than previous degree, is the CPT necessary for your current internship, why you take an intership after you have complete a fultime job... etc.

其实RFE不是问题，只要律师给力，专业相关，问题不大
