护照即将过期i20要失效了怎么办

学校回复：
Thank you for your email. We understand how difficult this is - keep all the documentation that explains these changes are outside of your control.

You are doing everything right and you are trying all the possible channels. Just keep working with the consulate and we hope this will be resolved soon.

是啊，我也觉得很纳闷。
我的理解是：
如果人在美国，I20有效的情况下，无论是F1签证过期还是护照过期，都没事。

当然，我的理解不一定正确。

我之前的理解是错误的。

特地去看了一下I20，果真写着这句话：

PENALTY. To maintain your nonimmigrant student status, you must: 1)remain a full-time student at your authorized school; 2) engage only in authorized employment; and 3) keep your passport valid. Failure to comply with these regulations will result in the loss of your student status and subject you to deportation.

楼主一定记得来更新后续啊

同学们，我今天做了好多research，我理解到的是，护照有效是一个并不十分严格的规定。这个可以商议的余地就是你有没有和你的embassy说明情况并且努力在续护照。我找到的两个sources:

Technically, yes. While you can’t travel by plane, if you have a car you can cross state lines because there are no “check points.” But I wouldn’t recommend it. If you are ever stopped and need to show your ID, but your passport has already expired, you could be deported.
What You Can Do

First, check the I-94 form you were given by the US Immigration Officer when you entered the country. That document will tell you how long you are allowed to officially stay in the US. It will have something called your admitted-until date or D/S notation. And the date shown on your admission stamp or paper Form I-94 is the official record of your authorized length of stay in the United States.

Then, contact your country’s Embassy and have them renew your passport.

If your country’s Embassy/Consulate cannot renew your passport then make sure you at least let them know your situation and register your presence. And make sure not to get into any trouble while you are in the US."

“The other issue: There's a separate part of CIS procedures that says a person has to have a passport valid beyond the expiration date of their Non-Immigrant Visa status (your student status). The purpose of this requirement is to avoid having someone in the USA whose country won't accept them. Theoretically, if your passport expired for Lower Slobbovia, you might get bounced from entering Lower Slobbovia and the USA would be stuck with you. So there is a more-or-less valid requirement for you to have a passport that's valid beyond the end of your I-94 period. There's a list of countries who have certified (upon pain of diplomatic embarrassment) that they will accept anyone with an expired passport, but since you didn't state which country you're from, no one can tell. ”


我的H1B COS被拒，我的绿卡律师今天说起这事问我：你护照是应为COVID的原因没法更新吗？你为啥没有在RFE里解释清楚呢？

所以我的感觉是，保留一切和大使馆邮件往来的记录，明确中国大使馆官方已经知道我们的处境，我们也在努力换护照，这些可以帮助咱们一定程度上减少麻烦。毕竟COVID特殊时期，相信USCIS不会一刀切的。

有一种说法：

同学们一定要保留证据，保存邮件。这个护照不过期的规定好像并不是硬性的。有尝试联系换护照的往来邮件也可以，当然最好早点换掉
