104名美国国会议员联名写信，反对缩减国际学生停留时间的DHS新规

更新：

今天，104名议员签好了信件，发给了美国国土安全部部长Chad Wolf。4页的信件（其中2页半署名）如下

发布新规之前，先在Federal Register进行公示，这说明国土安全部在按章办事。新规是否施行、最终版本内容如何，国土安全部说了算。美国国会，无论是参议院还是众议院，都无权直接下令取消。

但是，众议院有这么多议员明确表态反对新规，会给新规的推动者很大压力。对方必然要小心谨慎，严格按章办事。而发布新规之前，必须对收到的substantive comments做出回复，如果草率处理或者置之不理，会引发诉讼以及国会干预。

什么是substantive comments？提出具体问题、提出新的替代方案、指出法规草案里没有考虑到的影响，对于这类评论，政府部门必须回应。



近日，地里置顶热帖里大家总结的一些要点：

• 留学生overstay的数据包含了由于DHS无法证实其中已经离开美国但没有record的数据点，因此是非常不准确的，不能作为修改行政法规的依据。
• 【根据DHS自己的官方数据：https://www.dhs.gov/publication/entryexit-overstay-report 2018年到2020年overstay rate逐年下降，低至1.52%】 这么低的比例，没必要费劲去打击。
• overstay比例连年下降的，说明现行的系统（Duration of status）是非常有效的，为什么要用一个效果不确定的新系统（EOS）来替代?
• F1/J1 签证的overstay人数只占总overstay的3%，97%的overstay人数并不是来自于F/J签证，通过限制F/J签证持有人的居留时间并不能有效降低overstay人数。
• DHS这次的EOS会增加留学生1000刀左右的负担，并且增加USCIS每年300,000份的申请负担。现在I539，就是F/J延长境内身份转换的审批时间已经很久，表明USCIS没有能力有效的处理这么大的case load
• 建议通过推广学校E-Verify来加强对留学生境内身份的管理，而不是通过EOS这样效率低下，时间冗长的方式来增加留学生负担，降低美国大学竞争力。

最后，公示评论这几天冷了下来，提交的数目增长不多，今天是 17159。

之前我们呼吁：美国政府新规会让OPT名存实亡，大家行动起来！

有很多同学行动起来，不但自己写评论，也联系了学校，得到了积极的回复。

这位Karin Fischer是Chronicle of Higher Education（教育行业权威媒体）的Senior Writer。她提到的两位众议院议员，Debbie Dingell是密歇根州民主党议员，Mark Pocan是威斯康星州民主党议员。

这个消息真实性应该没问题。可见，美国大学们近期也在行动了。下面下周，我们也可以看看能征集到多少位议员的签名了。

尽管美国大学和国会议员在行动，但是，对这件事有决定权的是国土安全部，而且，无论如何，公示已经展开了，国土安全部当然有权走完流程。而我们要做的，就是继续写评论。这几天写评论的人数在减少。感觉冷了下来，还需要大家火力支援！

当然可以。国际学生、h1b等都可以给本州的议员办公室打电话。

欢迎大家周一打完电话之后，来地里介绍一下情况，讨论下如何调整策略。我们也会跟进宣传，希望有更多的人跟进。

提示：电话里、公示里，除了“反对”，要给出一些令对方无可指责的理由，比如overstay逐年下降，现行d/s系统有效，整体上overstay也很低，为什么要替换；eos的等待时间会被这么多f1大大延迟，而uscis average processing time在逐年下降，必然无法handle workload，会给国际学生造成很大的痛苦，等等。

这些都在我们总结的帖子里有。大家看完帖子，理清楚思路，就可以打电话了。

Hello, my name is (your name). I am a (graduate/prof./Ph.D./etc.) student at ( ___ University). I am calling today to speak to (member of Congress’s name) about the recent DHS proposed rule for international students with regards to duration of status.
(Now the person on the phone will likely say that they can pass on your message. They may ask for your name and zip code)
I am calling to urge [Congressperson’s name] to oppose the DHS proposed ruling that changes student visas from duration of status to fixed end dates. For graduate students, program durations are uncertain with the average time to degree being 6 years. With a visa duration of 4 years under the proposed ruling, many students would be unable to complete their degree with extensions, which DHS sets a very high bar for in this proposed ruling. Worse, students from some countries have this duration even further reduced to 2 years based on where they were born. This proposed rule would unnecessarily place a burden on international students and threaten hundreds of thousands of jobs supported by them. This disruption will threaten university communities and have a chilling effect on international students’ willingness to study in the US moving forward.

As a (graduate/prof./Ph.D./etc.) student and a constituent of your (district/state), I firmly oppose the administration using national security as an excuse to enforce impractical, unjust, punitive and inhumane policies and drive out international students.
