Tusimple被裁员了 H1B 身份讨论

我人在加州 今天12/21/2022开始算 grace peroid, 大家怎么办啊？

which means your grace period starts from tomorrow... (my lawyer told me when I got layoff earlier this year) good luck dude...

December 21, 2022 Dear Employee,
As you were informed in a separate communication, TuSimple has conducted a reduction in force that has resulted in the separation of your employment, effective February 19, 2023 (“Date of Separation”).
Please note that through the Date of Separation, you remain subject to all Company policies, including that you may not obtain employment elsewhere during your employment with TuSimple. If you do obtain other employment, you are required to notify the Company, and you will be considered to have resigned effective on the rst day of your employment elsewhere.
Additionally, although you will remain employed by the Company and continue to receive your normal pay and benets through the Date of Separation or until the date you obtain new employment, whichever is earlier, December 21, 2022 will be considered your last day of active work for purposes of your H-1B status .
To this end, TuSimple will be notifying the U.S. Citizenship and Immigration Services (USCIS) of the change in employment relationship and will request the withdrawal of your H-1B petition. Starting from December 21, 2022, you will have a grace period of up to 60 days or until the end of your authorized validity period, whichever is shorter, in which to pursue new employment, le an extension of stay, change to your nonimmigrant status or to timely depart the United States.
Please note that no work is to be performed during the grace period, and any changes in your immigration status are subject to the approval of the USCIS. Please also note there is only one grace period per authorized validity period, and it may be eliminated or shortened at the discretion of the U.S. Department of Homeland Security.
Finally, in accordance with federal regulations, we are offering you return transportation to your home country in the form of a one-way, non-refundable ticket. The Company is not responsible for and will not cover return transportation for your dependents or any other relocation-related costs, unless otherwise stated.
Please select an option and sign below. Please return this letter to me at immigration@tusimple.ai no later than Friday, February 17, 2023 or 21 days prior to your planned departure date, whichever is sooner. If we do not receive your selection by this date, we will assume that you have declined this offer.

之前有咨询过律师，如果不特意上报uscis，uscis会默认payroll的最后一天作为terminate date，然后才开始算grace period，但是如果公司特意和uscis上报讲明termination date，uscis会以公司上报的为准，这种操作对公司无任何好处，基本属于损人不利己的burn bridge行为

圣诞节前裁员，不给保留身份，真是从头到脚恶心到极致的公司.

话说Tusimple没给缓冲期？裁员就是第二天走人？

上报termination的话那就只有60天了，grace peroid立刻开始。。。但不知道这么搞公司是图啥

印象里好像之前有个帖里还有图森的上地里说会继续sponsor身份，这样害人不利己的洗地感觉有点匪夷所思…以后看到国人多的公司还是慎重吧 唉

我也是的 大家怎么办啊 明天开始算失业了 tusimple 把h1b terminate 和 payroll 分开了
不再支持H1B 了 一旦离职马上就开始算了

说实话，这操作除了整臭公司没有任何意义，别的人看了谁还敢加入这公司

我唯一能想到的就是吕程可能是真的想毁掉这公司，可能是上次被踢走对公司有仇，可能是想被layoff，毕竟如果吕程被layoff的话公司要给他1500万的，所以只要他就干出各种骚操作，等XD和陈默忍无可忍把他给裁了，他就可以拿到钱了

我过了一遍地里和Blind上面的瓜还有辞退信，我感觉我的推测越来越像是真的，但我觉得政府也有给图森施加压力

首先XD是没有了投票权了，为了回图森，XD把投票权给了陈默，所以他现在在图森其实已经没有什么话语权了。陈默虽然已经是最大的股东，但他其实也是图森的小透明，平时就没有怎么参与到运营里，对他来说只是一个投资的公司，能尽快脱手套现是最好的。吕程就不说了，他卖的股票比谁都多，而且如果被layoff还有1500万拿。所以layoff是吕程做的决定是跑不掉了

说个细节，Blind上有人在layoff前一周爆料说一楼的meeting room被booked了，当时大家以为layoff就在那一周，但后来又有人说无关，这个会其实是跟CFIUS开会，我查了下，这个机构是负责audit与外国投资有关的事务的，感觉是类似听证会的性质，让图森辩解自己没有出卖技术给国内的公司

所以我推测，这次对H1B的赶尽杀绝，更大的可能性是陈默和吕程在政府压力下为了撇清与中国的关系而做的决定。XD可能同意，可能不同意，但他没有权力做决定。不过回归溯源，图森之所以被CFIUS追杀也是因为图森跟Hydron有了利益输送，所以也不能说XD没有责任。btw，XD已经准备卖房，感觉是要跑路了

最后说一句，你司虽然很狗，但bar高也是真的，里面被离职的员工真的是无比优秀，只是因为管理层做的肮脏事，不得不提心吊胆的度过这个寒冷的holiday season，真的只能唏嘘，在历史的行程面前，人的努力是多么微不足道

如果是单身的话，可以试试转B2等明年找工作，明年初还不行的话就要先离境了。如果有家庭的话，就会方便很多。。在美国的一代移民还是要两个人一起啊
