DHS新规下, NIW 会影响OPT吗

楼主今年phd毕业，目前在tech 做 research scientist。目前在initial opt阶段，还没有进行h1b抽签，timeline上明年六月之后开始stem opt。最近考虑申一下NIW，但是有一个concern就是目前的新规会不会影响未来stem-opt的申请，因为律所提到了I-539 需要申报递交过的任何移民申请；但是因为 F-1 身份要求非移民意图，楼主不确定USCIS 会不会把I-140 纳入考量，影响stem-opt的申请。请大家给一些建议，谢谢

Tl;dr Redditors 写过他们有获批的类似情形。而USCIS官方文档显示， 仅仅只是有获批的140不至于使 OPT 或stem opt不能获批。楼主可以斟酌一下，实在不想冒险的话可以考虑申一下O1.

又，这个guidance 主要针对的是申请F1身份的人（change to F1 or consular processing)，而你是境内申请延期，感觉应该更加容易些才是。或许可以找一下有没有类似情况被拒的。
