Subject: H-1B FY2019 Quota case for XXX not accepted
Dear XXX,
We have received confirmation that the H-1B cap petition filed on your behalf was not accepted for processing under the Fiscal Year 2019 H-1B quota. On April 7, 2018, the United States Citizenship and Immigration Services (USCIS) has notified the public that the fiscal year 2019 H-1B quota had been met. USCIS conducted a lottery to determine which H-1B petitions would be selected under this year’s quota, and unfortunately, the H-1B petition filed on your behalf was not selected under this lottery. OPT没有过期: We have reviewed your file, and it appears that your OPT work authorization is valid beyond April 1, 2019, when the filing window for next year’s H-1B quota opens. We will, therefore, revisit the option to file an H-1B Cap petition on your behalf with your employer next year. Please let me know if any questions or concerns. Additionally, please send us a copy of your EAD card..--
OPT过期: As you know, your F-1 optional practical training (OPT) expired on XXX XX, 2018. Unless you are able to extend your optional practical training or obtain a new work-authorized visa status, you will lose your work authorization once your OPT expires. F-1 visa holders may qualify for an extension of their OPT if:
. Waral dи,
-The degree that is the basis for the F-1 student’s current period of OPT is a bachelor’s, master’s, or doctoral degree in one of the degree programs on the current STEM Designated Degree Program list, published at https://www.ice.gov/sites/default/files/documents/Document/2016/stem-list.pdf; and
-The F-1 student’s employer is registered in the E-Verify program.
It does not appear that you qualify for an extension of your OPT work authorization and F-1 status at this time. If you are unable to extend your OPT or apply for another alternative immigration status, please note that you would be required to leave the United States within 60 days of the expiration of your OPT work authorization. We, therefore, recommend that you contact the DSO at your university to confirm if you do not qualify. If you are married and have a spouse in another immigration status (e.g., L-1, H-1B, etc.) please contact us to explore other possible visa status options.
If you would like to discuss possible alternative visa options, please contact the attorney on your case.
Sincerely,
XXX
