Thank you for contacting me about the Fairness for High-Skilled Immigrants Act of 2019 (S.386). I appreciate hearing from you on this important matter.
The Fairness for High-Skilled Immigrants Act would amend the Immigration and Nationality Act to eliminate the per-country cap for employment-based immigrant visas and increase the per-country cap for family-based immigrant visas.
This bill seeks to address the backlog that applicants from high-demand countries face in their efforts to obtain a green card.
I believe our immigration system is broken and needs to be reformed. Please know I am committed to immigration reforms that protect against the exploitation of foreign workers, wage stagnation, and the displacement of qualified American workers. The immigration system needs to work for all Americans. We need meaningful reforms to mitigate fraud and abuse in our immigration system. We also need to address the green card backlog and provide an accessible pathway to citizenship for immigrants and their families who have been contributing to our country, and who, for decades have been our friends, coworkers, and neighbors.
The Fairness for High-Skilled Immigrants Act has been referred to the Senate Judiciary Committee, of which I am not a member. I will continue to monitor the progress of this bill, and I will keep your thoughts in mind should it come for consideration before the full Senate.

Thank you for contacting me to express your opposition to the “Fairness for High-Skilled Immigrants Act” (S. 386). I appreciate hearing from you, and I welcome the opportunity to respond.
As you may know, the Immigration and Nationality Act (Public Law 89-36) mandates that the number of employment-based and family-sponsored visas made available to individuals of a particular country cannot exceed seven percent of the total number of visas made available per year. I understand you oppose the “Fairness for High-Skilled Immigrants Act of 2019,” which was introduced by Senator Mike Lee (R-UT) on February 7, 2019. This legislation would eliminate the per-country percentage cap for employment-based visas and increase the per-country percentage cap for family-sponsored immigrant visas to 15 percent. S. 386 is currently awaiting consideration by the Senate Judiciary Committee.
As Ranking Member of the Senate Judiciary Committee, which oversees our nation’s immigration laws, I appreciate hearing your views on this important issue. I will be sure to keep your opposition to S. 386 in mind should this or similar legislation come before me for a vote.
