L1B,L1A,H1B 问题求解？

先介绍下自己. 本人本科学历，在美资公司上海分公司做技术工作13年，一个偶然的机会，老板问愿不愿意到美国工作2年？当时没有答应，2年以后也就是2015 好像突然想明白，到美国工作俩年再回来确实也不错，女儿那时正在上小学一年级。于是和公司申请到美国工作。2016年6月持L1B到美国。  在美国工作2年后，2018年10月左右，再次renew我们的L1B 签证（2年），大概是2018年11月公司决定让我长期留下来，并给一个team 让我管理，（亚洲 4个人，北美 1个人，欧洲现在是2个，2020很快会再找2个。）并给我申请绿卡。
2019 年抽 H1B 没有成功。
2020年准备继续抽H1B。如果没有抽中，10月份会再次回国renew L1B,(L1B 留美期限是5年）到2021年10月。
也就是2021年应该还有一次抽的 机会。
1）以前看帖子说L1A 转绿卡是不需要排期，但是写邮件给公司的律师，律师的答复是不能保证 L1A 就一定能拿到绿卡。稳妥点还是先L1B 转H1B,
2）由于一直不相信自己的运气，就写邮件给公司的咨询，按照我的理解是L1B 转L1A ，这样的话，我可以持L1A 再在美国呆7年，也就是抽H1B 的机会多些。昨天写邮件，今天得到律师的回复。
“If you are promoted to a managerial role, then converting you to L-1A is definitely possible. Having said that, an L-1A will only increase your stay in the US by additional two years. We are initiating your green card process, but, since you were born in China, you will not receive your green card in next 2-3 years, which means that you would need to leave the US for 1 year even after converting to an L-1A. Therefore, the best thing would be if you are selected in the H-1B lottery. If you are not selected in the lottery, we can discuss the alternatives for you, i.e. if it is better for you to leave the US for a year earlier or you are eligible for an L-1A conversion.”
现在有点迷糊了，求解？
1）Having said that, an L-1A will only increase your stay in the US by additional two years. L1B 换成L1A 是可以多呆2 年不是 7年？
2）We are initiating your green card process。 L1B 签证可以直接转 绿卡吗？已经在处理我们绿卡，是因为我来自中国需要排队大概5年，L1B或者L1A 的时间不够支撑到拿绿卡。所中间还需要离开没有一年，再申请L1A或者L1B进来？
3）按照我的理解，如果抽中H1B，然后按步骤 I-140,I-485....,拿绿卡。 为啥现在H1B还没有影子，就在 initiating your green card process？好像不符合逻辑。
4) if it is better for you to leave the US for a year earlier or you are eligible for an L-1A conversion.现在看起来，抽不到H1B ，不管转不转L1A都得出去呆一年再回来？

AFAIK
签证和绿卡是分开的，申请EB1C和申请L1A的条件类似，但是互相是独立的
EB1C的类别叫Multinational manager or executive，必须得是Multinational
所以有的印度人会先选择去新加坡加拿大分公司工作，然后再去美国，这样能走EB1C，虽然队也很长总比EB2强

EB1C要求在申请的前三年内至少在同公司有一年的海外的管理工作经验。

刚刚又收到律师的邮件，好像和你说的一样！

xxxxx Technology Inc. has requested that we initiate the green card process on your behalf. Congratulations!  The first step in this process is the filing of a PERM labor certification application with the Department of Labor.  This requires that xxxxx Technology Inc. demonstrate to the DOL that there are no “qualified, able, and willing” US workers who can fill your position.  This requires that we place ads and other recruitment, which the DOL will review when we file your case.
The application process has recently been taking 10-12 months from start to approval. Note, however, that DOL has the option of auditing cases, which can result in an additional 6 months.  Should this case come up for audit, we will contact you to provide updates on anticipated processing time.

估计L1A把你已经呆的5年算进去，所以只会给你补2年。现在以L1A身份通过EB1C申请绿卡也已经要排队了，网上可以查到排期时间，按照你转完L1A然后启动EB1C类型的绿卡申请，在满7年的时候绿卡很可能没有下来。你现在就可以启动EB2 PERM申请，即使现在是L1B身份，PERM可以跟你申请转H1B同时进行，H1B只是给了你足够的时间去等待EB2绿卡排期。地里好像看到过一个帖子，15年的PD，后来去了加拿大，再以L1A（？或者H1B）身份回来，沿用之前的PD，在去年底拿到了绿卡，你可以去搜一下！祝好运！

主要是你在美国已经待了四年了
后面转L1A的话最多还能待三年
律师无法保证里三年内一定能拿到绿卡
如果你无法拿到L1A到期你必须离境

顺便请教下在美国拿到MGR职位就可以申L1A吗
我之前看到的要求是要在国内担任高管或者MGR 过去还是高管或者MGR才可以
我跟你情况还比较像 如果能走L1A尽量走L1A 因为排期压力小很多

律师是这样说的：
“If you are promoted to a managerial role, then converting you to L-1A is definitely possible.”
也就是在美国被promote成manager 也是可以的，不一定需要在国内也是。

AFAIK
排期跟L1B还是L1A没关系，排期看的你是EB的那个Category
美国国内转经理可以L1B转L1A，但是不能从EB2转EB1C
