分享一下关于USCIS更改F1 OPT的寄送地址询问到的律师答复

lz的Initial opt是02/18/2021过期，在01/06/2021这天，由我们公司的律所帮我file了STEM OPT的申请（到AZ），感觉应该在一两天之内能寄到。但是在01/08这天早上，突然注意到了USCIS关于更改F1 OPT申请的地址到Chicago Lockbox的消息，立马发邮件问了律师。得到的答复是这样的：

Nothing like an overnight address change from the USCIS to start off 2021. There was absolutely no forewarning about this. When this type of situation happens, while infrequent, it can also create rejection issues at the new service centers. Employees in Chicago who do intake on cases may not be full aware of the case processing shift.

When we filed your case, the address per USCIS was Phoenix. However, it is unclear if the case will be rejected or accepted. Truly depends on how quickly USCIS was able to update its protocols at the receiving facilities.

We submitted your STEM with a G-1145 form which means that you will be notified electronically when the case is accepted by USCIS. Let's pause on an immediate re-file until early next week. If you do not receive notification by end of business on Monday(01/11/2021), we will re-file at the new lockbox.


收到这样一份回复之后，因为我知道最近receipt的发放有很大程度的延迟，一个月都不一定能收到，更别提过两天的周一了。于是又回邮件询问到底是否要重新提交一份到Chicago，得到的回复如下：

USCIS has staff working overtime to get through the cases sitting at the lockbox. In our filings, we have really seen the biggest delays in Texas. Your case was sent to Phoenix, not Texas so that’s a start. If their staff is working overtime, it’s possible you could get electronic notification from them. We can quickly re-file to the Chicago location, but I hesitate to do that immediately due to the reasons said below. This was a re-org of where cases would be filed and we routinely have issues with Lockbox facilities rejecting cases because staff is unaware or untrained. With any option there is a risk, but we’ll ensure that one way or another, your case is received by USCIS.

所以现在暂时的结论就是静观其变...并不推荐立马立即重新寄一份到Chicago，但是我剩余的时间也不多了，离我的initial opt结束只有大概一个月的时间了。我现在也已经发邮件问了我们学校的international student office关于这件事他们的建议，但是还没收到回复。收到回复我会在此更新。相信还有其他同学也是在USCIS改地址这一两天前寄出到TX或者AZ的，或者有的同学是之前早就寄出到TX但是一直没有receipt在犹豫是否要重新寄一份到Chicago的，希望能有同学一起讨论一下关于是否应该re-file...

01/15 学校回复说既然我已经寄出去两份了，之后就不建议withdraw了，会把事情搞复杂，建议我就干等着就行了。

01/21 收到了短信和邮件，是Chicago的receipt number, recived on 01/14/2021，MSCk开头的。寄到AZ的第一份没有动静。

你在地址没改之前寄到了AZ，这肯定没问题啊。AZ现在处理到11.26了，而且上周六还加班了。所以你还是可能在过期前收到receipt. Chicago还没见报dp呢，而且也不知道他们是先处理积压的还是新的，而且你律师还担心工作人员熟不熟悉流程，觉得也有点道理。

今天问了学校，没寄出的就往Chicago送，寄出的就等等receipt

今天打电话问了uscis客服 说在更改前邮寄到tx 或者az 不一定有问题 但他们也不确定 等于白说 建议我发个email给tx po box问问

楼主请问下lockbox变更的source在哪里？我明天发邮件问问学校

今天学校有答复了：不推荐新寄一份到Chicago

Thanks for reaching out!  Please do not send another application, since this could cause automatic rejection of both applications. Since you mailed your application prior to the change, it should be fine.

赶紧拿着学校的答复又去问律师，律师回复说：之前USCIS改地址的时候都会提前通知，并且会给出一个deadline，但是这次他们并没有。因为TX/AZ已经不再被允许接受opt的case，所以他们有权拒绝你的申请。律师在我的第二份申请中加了一个cover letter用来说明这是一个refile，原因是因为extensive delay of receipt and filing address change 同样律师有其他同事也帮其他同学refile了申请，原因是寄到了TX但是一直等不到Receipt。律师不建议我现在联系USCIS，让我耐心等待，如果将来我收到两个receipt，那么他们会帮我把晚的那一个withdraw。

你好，请问TX 没收到receipt还是可以refile的是吗，只要写cover letter解释就可以是吗？

同学你好 能不能帮忙问下律师 withdraw第二份会不会影响SEVIS状态 进而影响到第一份？ 谢谢谢谢！

这个我觉得需要根据自己的情况来决定，比如你的i20是否过了30/60天的期限。不过一般学校都不推荐重新再寄一份新的。
