川普的出生公民权行政令被高院驳回了

虽然是意料之中，不过看了6比3的投票，以及反对派法官的意见书，感觉未来宪法可能都没那么稳了。

为什么我说不稳？因为Alito的反对意见完全基于不当理解。
宪法第十四修正案第一款白纸黑字写的是
 All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

而Alito的反对意见是：
Alito argued, “shows that it does not degrade the concept of United States citizenship in this way. Instead,” he contended, “the Fourteenth Amendment confers citizenship on only those children who, at birth, owe allegiance solely to this country.”

at birth, owe allegiance solely to this country？？
这是什么鬼？美国宪法从没明确说明要求婴儿出生就仅效忠于这个国家。
作为最高法院大法官，对宪法的解读向这个方向发展，只会对之后的司法体系和下级法院系统产生负面的影响。

讲道理出生公民权这个判决，6-3或5-4挺让人担忧的。这种明晃晃违宪的EO从一开始就不该被最高法受理，即使受理了也应该至少是7-2甚至9-0。（判决前大部分人预测那个2是Thomas和Alito。）
这个比分会鼓励更多极右翼政客在未来用更完备的手段challenge出生公民权。

Thomas和Alito是属于连脸都不要的。标榜自己是宪法原旨主义，实际上完全是按党派立场投票。
