H1B 申请期间出入境会造成什么影响

各位好，有一个关于H1B申请期间能不能Travel，以及会造成什么影响的问题
我的OPT 2019 6月末 到期，想要4月中旬回国一趟，F1 visa也没过期，出入境应该没问题的吧？

1号接到律师的信说是H1B申请了，并附赠一段话：
In most cases, the H-1B petition requested a “change of status” in the United States to automatically convert you to H-1B status effective October 1, 2020 (or thereafter when the H-1B cap petition is approved); therefore, please remember that any international travel while the H-1B petition is pending (and in some cases, before an approved H-1B petition takes effect) may have an impact upon your ability to change your visa status, your ability to reenter the U.S. after international travel, and the continuity of your current employment authorization.


是不是说如果我4月十几号travel就不能自动转换成H1B status，我疑惑的点就是，除非我今后就不出美国了，我早晚不还是要回国做consular processing，换成H1B visa才能再次入境的吗？那这样来说就是没有影响的是吗？有没有大神能给我排异解惑一下，我公司律师不理我....

就是说如果我10月份之后也是要从美国往外的跑的其实，自动转换status和回国stamp没有区别，但是比如说如果我被RFE了（呸呸呸），12月份才approve了，那如果自动转换H1B status，我就能继续在美工作，但如果是回国stamp就必须10月1号从美帝出去，等到approve了，办好了签证再回来工作，是这样吗？这样理解对吗？

The H-1B Petition is pending – may the employee travel?We do not recommend international travel while a change-of-status application is pending, as thistravel may nullify the change-of-status request. If a change-of-status request is nullified, the employeewould be requested to leave the United States again to activate his/her H-1B status. Specifically, theemployee would have to apply for an H-1B visa stamp at a U.S. Consulate abroad, present the new H1B visa at the port of entry, and re-enter the United States. The earliest a beneficiary would be able toenter the United States would be ten days prior to the effective date on the H-1B approval notice. Theemployee would not be permitted to work pursuant to his/her H-1B status until the effective date ofthe approval notice.

opt到期前出国又回美应该没问题。opt到期后尽量别动了。

你律师给你申请的是change of status，抽中了自动换身份的，这种如果期间出国，自动换身份就无效了，抽中了需要回自己国家大使馆去办理身份转换。
H1B常规申请有两种，一种是上面说的change of status，另一种CP，就是抽中后去自己国家美国大使馆办理。
一般你这种有出国需求的都用CP的方式抽签，负责的律师在帮你抽签前都会问你的，我连续两年都用的cp方式。

我的理解就是你travel了，抽中了，change of status的方式作废，就自动变成cp的处理方式才能生效了。google上有很多老外的例子。没事的。随便出国。

我是因为老要离境出差，所以很看了很多印度人的例子哈哈。我才仔细看了你的问题。如果change of status的话就和你理解一样，只要你抽中了，不需要回国去大使馆，一直在美国自动变成h1b身份，有朝一日你想离境了，就得回中国大使馆办一下。
你这个情况就是change of status自动作废，但抽中了还是可以回大使馆办理~
