Civil Rights Violation USCIS Report Letter Template

针对有人在绿卡板块发布了可能因为亚裔或者华裔作为AOS申请人interview被歧视的帖子。我根据他的遭遇写了一个以下的向USCIS举报信的模版。

抛砖引玉，大家可以酌情增减内容。

如果USCIS或者DOS不及时回复，可以考虑找Senator举报这个Civil Rights Violation。

注：我本人认为根据已有的事实和逻辑不能说明这个面试官有歧视，不过如果当事人自己认为自己被歧视了，可以拿起法律、舆论等等的武器维权。我在这里尽绵薄之力。

Report of Civil Rights Violation during USCIS Adjustment of Status (AOS) Interview

Dear Sir or Madam,

My name is Xiaoming Huang. I would like to report a Civil Rights Violation during my Adjustment of Status (AOS) Interview with an USCIS officer.

On October 1, 2022, 10:00 AM MST in the USCIS field office (Ste 100, 1000 Fair Oaks Ave, Indianapolis, IN), I attended my I-485, Adjustment of Status application interview with USCIS officer Mr. John Smith for. During the interview, Mr. Smith abruptly asked me whether I think the COVID-19 virus is a “man-made virus”.  

As an Asian and Chinese American, I found this question offensive and insulting during an official interview for my Adjustment of Status. Mr. Smith asked this question about COVID-19 without a legitimate reason or a meaningful context. We were not in discussion about science nor biology. None of my education background, employment, and all other material for my AOS application is relevant to COVID-19 virus. His question alluded to me that he is suggesting a special connection between Asian or Chinese Americans and the COVID-19 virus. [Fill in the reasoning].

I believe that this act of questioning me of whether COVID-19 virus is “man-made” is because of my Asian race and Chinese national origin. This act is a malicious discrimination, an intentional intimidation, a blatant harassment, and therefore a Civil Rights Violation.

In 1964, Congress passed Public Law 88-352 (78 Stat. 241). The Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, religion, sex or national origin: “SEC. 202. All persons shall be entitled to be free, at any establishment or place, from discrimination or segregation of any kind on the ground of race, color, religion, or national origin, if such discrimination or segregation is or purports to be required by any law, statute, ordinance, regulation, rule, or order of a State or any agency or political subdivision thereof.” I believe Mr. Smith, a representative of the USCIS, violated this Act by asking me that COVID-19 virus question.

Martin Luther King Jr. said “Our lives begin to end the day we become silent about things that matter.” As a victim of this Civil Rights Violation, I choose not to remain silent. I hereby kindly ask USCIS and Mr. Smith to do the following three things to remedy the fault.

Apologize, both publicly and privately, to me, all the previously harassed AOS petitioners if any, and Asian and Chinese American communities, about this, and all the previous discriminations and Civil Rights violations of such kind.
Promise not to commit any Civil Rights violations against any applicants because of their backgrounds.
Commit to conduct full and comprehensive Civil Rights education, as well as education about the history of Asian and Chinese Americans, to all the USCIS staff and employees.

原帖里面那些义愤填膺的人快过来帮忙啊？

支持楼主！ 但是提个小建议，最后几段诉求的部分尽量写可以实现也可以enforce的。像公开道歉和承诺不歧视其他亚裔申请人这样的诉求感觉稍微画蛇添足。个人觉得更实际的诉求是，确保举报人的个人申请不受影响以及要求调查这个面试官是不是系统性的歧视或者刁难其他亚裔申请人。

@hot_1214 原帖lz可以参考一下。如果你觉得你的权益收到了侵害可以在信里面加入你的细节然后举报。如果USCIS或者DOS懒政的话可以联系Senator。
